This Notice is to inform you about a lawsuit filed on Tuesday, December 5, 2006, in which plaintiffs allege that they and others who are "similarly situated" have purchased or are under contract to purchase condominiums wherein the square footage is approximately 100ft. less than was represented by the Seller, and to advise you of how your rights may be affected by this lawsuit and to instruct you on the procedure for participating in this lawsuit, if you decide that is appropriate and if you choose to do so.
2. DESCRIPTION OF THE LAWSUIT [top]
On Tuesday, December 5, 2006, 4 individually-named plaintiffs filed a complaint in the Eighth Judicial District Court of Clark County against Gemstone LVS, LLC dba Manhattan Luxury Urban Condominiums. The Complaint was on behalf of the named plaintiffs and all buyers who are similarly situated. The Complaint alleges violations of fraudulent misrepresentations with regards to the square footage of each unit and seeks to void the contract, to reimburse plaintiffs all monies paid plus interest, and/or to award plaintiffs damages for the square footage discrepancy in each unit.

If you are currently under contract to purchase or have already purchased a Manhattan Luxury Urban Condominiums located at 26 E. Serene Ave., Las Vegas, Nevada, you may wish to participate in this lawsuit . Your ability to participate in this lawsuit depends on your intentional act to "opt-in" as a party. To do so, you must complete, sign and return a copy of a "Consent to Sue" form and a "Retainer Agreement" which allows our office to act on your behalf as your attorney with regards to this lawsuit only. It is entirely your own decision whether or not to join in this lawsuit. You are not required to take any action unless you so desire.
